Guarantee and statutory warranty – what is the difference?

Despite the greatest care during manufacture and in the selection of the materials used, defects can never be completely ruled out. To safeguard consumers' entitlement to flawless products, there is the statutory warranty. In addition, manufacturers and retailers underpin the quality of their products through voluntary services in the form of a guarantee.

Difference between statutory warranty and guarantee

The statutory warranty is based on § 438 BGB (German Civil Code) and can never be excluded by contract. In the normal case, the warranty period is 24 months. An exception is the statutory warranty on second-hand goods. If the buyer agrees, it can be reduced to 12 months through the general terms and conditions or by agreement. If a defect occurs within the first six months after delivery, the seller must provide proof of the flawless condition at the time of delivery. After this period has elapsed, the buyer must demonstrate that the defect already existed at the time of acceptance. Depending on the product, the seller has the right to refer to certain exceptions which, owing to their particular nature, are not covered by the statutory warranty.

The situation is different with the guarantee, which serves solely to supplement the statutory warranty. This is always a voluntary service provided by a manufacturer, who may at the same time be the retailer. The guarantee, for example, promises the flawless functioning of a product for a certain period. If this is not the case, a free repair or replacement is carried out.

Guarantee conditions and periods at FENSTERNORM

Should any questions or problems arise in connection with the items ordered, the following conditions apply:

  • Window profiles - 5 years. The guarantee only applies when the product is handled properly and relates to defects that arise as a result of material or manufacturing faults.
  • Mechanical function of the hardware - 3 years. The guarantee likewise only applies when handled properly and to hardware that is not exposed to exceptional weather conditions.
  • Glazing - 5 years' guarantee against the formation of condensation between the panes in the insulating glazing.
  • Sun and insect protection - 2 years, provided that proper installation and use are demonstrated.
